EEC Acquisition LLC d/b/a Smart Care Equipment Solutions (“Smart Care”) operates the website at https://smartcaresolutions.com (the “Site”). Terms such as “we,” “our” and “us” refer to Smart Care. Smart Care values your privacy. This Privacy Policy describes how we collect and handle information that we receive through our Site and all related and subsidiary webpages and through access to any optimized version of our Site via a wireless device.

By accessing and using the Site, you consent to the collection, use, and storage of your information by us in the manner described in this Privacy Policy.  We reserve the right to change and update this Privacy Policy and such updated versions will be posted on the Site.   In addition to this Privacy Policy, your use of our Site is governed by our Terms of Use.

How We Collect and Use Information

Personally Identifiable Information collected in general

We may collect personally identifiable information (“PII”) such as your name and contact information if you choose to provide it to us.  For example, the Site provides an option for Smart Care customers to make requests for repair services (“Services”) through completion and submission of a service request form.  The service request form will require you to submit your name and e-mail address, customer number, company address, company and information about the equipment make, model and service issue for which you are seeking service.  In addition, you may choose to submit questions or comments to us by completing and submitting a Contact Us form and providing your name, e-mail and/or address.  Smart Care maintains and uses the PII you provide in order to respond to your inquiries and comments, facilitate your service requests, and analyze and improve our services and to conduct marketing.

Personally Identifiable Information collected in general

If you choose to apply for an employment position at Smart Care through our online application process, you will be requested to provide, and we will collect, PII which includes your contact information, employment history, education, experience, technical skills, licensure, and in some circumstances, further information about you from references and external assessors.  Some positions may require more detailed information.  You can decide what personal information you provide to us through the application process but, as indicated in the application, some information is required to be considered for employment.

The information you provide as part of an employment application will be used to process your application and consider you for employment opportunities with Smart Care in the United States as well to respond to your inquiries and requests.

Any information you voluntarily choose to provide in the equal opportunity sections of an employment application or upon hire with Smart Care will be used only in accordance with applicable affirmative action and employment laws, executive orders and regulations.

Access to your PII submitted as part of an employment application is limited within Smart Care as necessary for consideration of your application.  In addition, we may share and disclose your PII to third party vendors engaged by Smart Care to help us process and administer applicant data in accordance with our instructions and such third parties providers are bound by agreements and required to restrict their use of such PII received through our Site to the intended purposes of facilitating our employment application process and consistent with Smart Care’s commitments to you in this section of our Privacy Policy.

If your application is successful, your PII will be used in the administration of your employment consistent with applicable law.  If your application is unsuccessful, Smart Care may retain and use your PII to follow up on any matter which may arise in connection with your application and employment opportunities, for data analysis, general management and our business purposes, as well as may be required under applicable employment and affirmative action laws, executive orders and regulations.  You may withdraw yourself from a particular requisition at any time by contacting us at careers@smartcaresolutions.com and, through the applicant portal, you have the ability to update, modify or delete your information at any time.  If you withdraw an application and delete your account, Smart Care will stop contacting you regarding employment opportunities however Smart Care may continue to retain your PII as permitted and/or required under applicable employment and affirmative action laws, executive orders and regulations, and other applicable law.   If you have any questions or comments about your personal information collected as part of an employment application, please contact Smart Care through the careers section of our website or at the following e-mail: careers@smartcaresolutions.com

Disclosure of your PII

Smart Care will not sell or rent any PII collected on this Site to third parties for their direct marketing or other purposes.  In addition, any PII submitted to us for employment purposes through the application process will not be used to market products or services to you.

We may share and disclose your PII to third party vendors engaged by Smart Care to help manage our Site, provide advertising and marketing services, respond to inquiries or fulfill other requests and to assist us.   In general, we require our third party service providers and vendors to restrict their use of such PII received through our Site to the intended purposes.  Notwithstanding any of the foregoing, Smart Care may disclose any PII collected through the Site to comply with any legal obligation, to enforce or apply our Terms of Use or to protect our rights or those of other parties.  In addition, we may need to, and we reserve the right to, disclose or transfer any PII to third parties in connection with selling or liquidating any part of our business or assets.

Non-Personal Information

The Site collects certain standard internet log information that you do not visibly enter, such as your IP address, browser type, click stream data, HTTP protocol elements, and the status of cookies placed on your computer by Smart Care.  In addition, in order to manage and improve our Site, we or our service providers may use cookies (small packets of information that are stored by your web browser) or web beacons (electronic images that allow us to count visitors who have accessed a webpage).  These tools do not identify you personally and allow us to track and analyze aggregated usage data about our Site and its use.   Our Site may also use third party analytics vendors such as Google Analytics.  Please click here for more information about how data is collected and processed in connection with the Google Analytics service:  https://policies.google.com/privacy/partners.  We and our third party vendors or partners use analytics data for a variety of purposes such as to improve the design and content of our Site and understand what users like to see.

You may choose to block or disable cookies from your device using your browser settings or options.  However, this may impact your user experience and parts of the Site may not work for you.  You cannot remove or block web beacons as they form part of the content of the web pages, however because they work in conjunction with cookies, turning off cookies will prevent web beacons from tracking your user activity on our site.  The beacon can still account for an anonymous visit, but your unique information will not be recorded.

All non-personal information collected through this Site may be used and shared by us without any restriction.

Do Not Track Disclosure.  This Site does not monitor for or behave differently if your computer transmits a “do not track” or similar beacon or message.

Your Choices; Updating your Information

If you do not want us to collect PII from you, you should not submit such information to us.  If you opt-in to receive updates and information from us by completing a form or submitting a request, we may send you e-mails about a variety of topics, products, promotional offers and company information.  In such cases, the contact information you provide to us may be shared externally to enable third party agents to send e-mails to you on our behalf, or may be shared in anonymous, aggregated form for generalized user analysis.

At any time, you may choose to unsubscribe from such mailing lists. To do so, please either follow the links or instructions on the bottom of such communication or e-mail or send us a message as described on our Contact Us page with your full name and e-mail and a request to unsubscribe.

At any time, you may request changes to the PII that you have previously provided to us by contacting us as described on our Contact Us page.

Security

Smart Care has implemented generally accepted standards of technology and operational security in order to protect personally-identifiable information from loss and misuse. Despite these precautions, Smart Care, however, cannot guarantee that unauthorized persons will not obtain access to your personally-identifiable information.

Transborder hosting and transfer of information

Except as otherwise provided (for employment applicant data), PII collected on the Site may be transferred from time to time to Smart Care offices or personnel, or to third parties, located throughout the world, and the Site may be viewed and hosted by Smart Care or its vendors anywhere in the world, including countries that may not have the same data protection laws as those in your country of residence. By using the Site and registering such information on it, you voluntarily consent to such transborder transfer and hosting of such information.

California Privacy Notice

California Civil code § 1798.83 provides certain rights to California residents, including the right to request information from a business, with whom the California resident has an established business relationship, regarding the business’s disclosure of personal information to third parties for marketing purposes by such third parties during the immediately preceding year.  To request such information pursuant to Section 1798.83 of the California Civil Code, please contact us by using the Contact Us form.

Children’s Online Privacy

The Site is not designed for or directed at children 13 years of age or younger, and Smart Care will not intentionally collect or maintain information about anyone under this age.   If you think we have received or collected personal information from a child under the age of 13 through this Site, please contact us as described on our Contact Us page.
